Welcome to www.bmall.ae. These Terms & Conditions govern your use of our website and the services we provide. By accessing and using our website, making a purchase, or interacting with our brand, you agree to comply with and be bound by these Terms & Conditions.  

1. Acceptance of Terms 

www.bmall.ae (the "website") is owned and operated by Boutique Mall SRL, trading as Boutique MALL , for its own benefit and the benefit of its affiliates and subsidiaries (together "we", "us" or "our”). 

By accessing and using the website at www.bmall.ae, you agree to comply with and be bound by these Terms & Conditions and any other applicable laws and regulations. If you do not agree with these terms, you must not use our website. 

These Terms & Conditions may be amended from time to time, and your continued use of the website will constitute your acceptance of any updates or changes. 

2. Eligibility 

You must be at least 18 years old to use this website and make purchases. By creating an account, placing an order, or making a purchase, you confirm that you are at least 18 years of age or have parental/guardian consent to use our services. 

3. Account Registration 

To make a purchase or access certain features of the website, you may need to create an account. When registering, you agree to provide accurate, current, and complete information. You are responsible for maintaining the confidentiality of your account credentials, including your username and password.

4. Product Information 

We strive to provide accurate and up-to-date information about our products, including descriptions, images, and prices. However, we do not guarantee that the content on our website is always accurate, complete, or error-free. Product availability is subject to change without notice, and we reserve the right to limit the quantities of products available for purchase. 

Items in your website basket are not reserved until your order is paid for in full and accepted by us. The website may contain or provide information regarding the availability of a particular item. The availability & delivery information provided on the website is only an estimate and may not be up to date at the time of placing an order due to the frequency of the transactions that are carried out on our website. Unfortunately, we cannot always guarantee that an item which is displayed as in-stock on the website at the time you placed it in your basket will be available at the time you place the order. Should this happen, we will notify you and arrange for a full refund to your original payment method. 

Pricing  

All prices on our website are listed in UAE Dirhams (AED) and do not include any fee chargeable for services you may select as checkout (such as gift wrapping), delivery costs, customs duties and other charges to which the order may be subject to may apply. Any such additional costs will be calculated and added to the order price at checkout 

Please note: We reserve the right to modify prices, offers, and promotions at any time. 

Although we make every effort to ensure the prices or charges communicated to you in connection with your order are accurate, errors may occur and we reserve the right to correct such errors by cancel the order (or part thereof) and issue you a refund. 

Payment 

When you place an order using a payment card that only processes payments in a currency other than the currency that applies to your order at checkout, the payment will be subject to the currency exchange rate applied by your card issuer at the time your payment is processed. Your bank or card issuer may also charge other fees for processing the payment. 

We accept payment via various methods, including credit/debit cards and other secure payment options. Payment is processed at the time of purchase. By submitting your order, you confirm that the payment method you are using is valid and that you are authorized to use it. 

Placing orders, cancellation and changes 

Once you place an order with us, you will receive an email confirming receipt of your order. This email serves as an acknowledgment but does not constitute acceptance of the order. We reserve the right to cancel any order at any time, including if an item is out of stock or if there are issues with payment. 

Orders are only accepted once payment has been successfully processed, and we will confirm shipment of the order by sending you a dispatch confirmation email. 

Prior to your order being marked as "Processed" on our online order tracking system, you may contact us or use the website to cancel or change the order. If you do so, at your request, we will either: 

  • cancel the order free of charge and issue you with a full refund, or  

  • agree to make certain changes to the order, subject to stock availability and any applicable price adjustments.  

If the order has already been processed by us, you will be unable to cancel the order or make changes to the order. You can return the items in accordance with our returns process after you receive the order for a refund and alternatively place a new order with the items you wish to purchase. 

Shipping & Delivery 

Shipping costs and delivery times vary depending on the destination and the shipping method chosen at checkout. We aim to deliver your purchase within 5 business days. Delivery times are estimates, and we do not guarantee delivery by any specific date. 

Customs & Import Duties: Additional duties, taxes, or customs fees may apply. These charges are the responsibility of the customer. 

We often source your favourite products from different locations, so to ensure that we get your items to you as quickly as possible we sometimes have to split your order into two or more shipments. In these cases, we will notify you that your order will be arriving in multiple shipments. You will not be charged separately for the delivery of each shipment. 

Returns & Exchanges 

We want you to be completely satisfied with your purchase. If for any reason you are not happy with your order, we accept returns and exchanges under the following conditions: 

  • Returns must be made within 14 days from the date of delivery 

  • Items must be: 

  • unaltered, unused and in their original condition (or the condition in which they were received by you from us or our agents); 
  • in their original packaging/box/dust-cover and with all brand and product labels/tags/instructions still attached;
  • authenticity cards, where provided, should also be returned;
  • swimwear must have the original hygiene liner attached; and  
  • Some items, such as underwear, swimwear, and earrings, are non-returnable for hygiene reasons. However, non-returnable items may still be returned to us if you accidentally received the wrong item in your order, or if the item was received damaged.

We will aim to process your return within 3-5 business days from us receiving the package back, and if accepted, the refund will be issued to your original form of payment, unless stated otherwise in these Terms of Service. However, sometimes the time needed to process your return might be extended up to 14 days.  

We monitor the quantity of returns and reserve our right to either close your Boutique MALL account or limit your ability to place future orders should you have a high return rate or your return behaviour violate our Returns Policy. 

SHOES 

Shoe returns will only be accepted if the shoes are in the condition they were receive in and without any damage to the items or their packaging. To avoid damage, shoes should only be tried on carpeted surfaces. Any items returned with scuffing, scratches, dents, or any type of damage or visible signs of wear will not be accepted and will be returned to the customer with a rejected refund request. 

NON-RETURNABLE ITEMS 

We do not accept returns for lingerie, swimwear, jewellery.  

EXCHANGES 

Items can be exchanged by arranging collection from your delivery address and the following conditions apply: 

  • You can exchange an item for a different size only if it's the same product. 

  • The exchange order is only created after the return is approved. 

  • Exchanges are only for eligible items with the same price, located in the same warehouse, and must be returnable. 

DAMAGED GOODS AND WRONG ITEMS 

If an item in your order is received damaged or is not the item you ordered, you can arrange to return the item to us by following our returns process. The item must be returned to us in the same condition you received it in, within 14 days of delivery of the order to you. Subject to being satisfied that the item was in fact damaged, we will replace the faulty item at your request and deliver to you a new item free of any delivery charge. If there is no possibility to replace the item, we will issue you a full refund including, where applicable, original order delivery charges, cash handling fees, taxes and any duties.  

Refund Process 

All items returned to us will be inspected. If we are satisfied with the condition of the item returned, we will process the return and notify you once a refund has been issued with the value of the refund. Your refund will be paid back to you depending on your original payment method. 

Please note that we cannot refund items if the return is initiated after 14 days of processing your order. If you return an item to us after the 14 days period, we will return it back to you as it has surpassed the refund deadline. For credit card refunds, it may take up to 14 days for your credit card provider or bank to process the refund and for the refund to be reflected on your card statement. 

Intellectual Property 

All content on this website, including text, images, logos, trademarks, and designs, is the property of Boutique MALL and is protected by intellectual property laws. You may not copy, reproduce, distribute, or use any of our content for commercial purposes without prior written consent from us. 

Privacy and Data Protection 

Your privacy is important to us. Please refer to our Privacy Policy for detailed information about how we collect, use, and protect your personal information. By using our website and making a purchase, you consent to the collection and use of your personal data in accordance with our Privacy Policy. 

Limitation of Liability 

To the fullest extent permitted by law, Boutique MALL is not liable for any direct, indirect, incidental, special, or consequential damages arising from your use of our website, the purchase of products, or any other interactions with us. 

We do not guarantee that the website will be error-free or uninterrupted, and we are not responsible for any technical issues, including those caused by third-party providers, that may impact your ability to access or use the website. 

Prohibited Conduct 

You agree not to engage in any of the following activities on our website: 

  • Violating any applicable laws or regulations. 

  • Uploading or transmitting harmful content, including viruses or malware. 

  • Interfering with the security or functionality of our website.
